What is an Election of Rights?
If the Department of Health files an administrative complaint against you, they send you an election of rights along with it. And that’s your chance to decide how you want to respond to the complaint. You’ve got three choices. You can say, I give up and I will relinquish my license. Or you can say, I didn’t do it. I dispute your facts and I want an administrative hearing to present my case. Or you can take a middle ground, which is, I don’t dispute your facts, but I want a hearing, an informal hearing, before the board to present my side of the story.
